A Telangana Court dismissed a plea filed by the Hyderabad Police seeking judicial custody of the three people, associated with the Bharatiya Janata Party (BJP.)

Notably, the Hyderabad Police arrested  Mr. Ramachandra Bharati alias S. Satish Sharma from Delhi and Simhayajulu from Tirupati, both are said to be temple priests and Nanda Kumar, a businessman from Hyderabad, a close associate to a union minister.  The arrest was said to be in view of the allegations that the BJP is trying to poach the Telangana Rashtra Samithi (TRS) Members of the Legislative Assembly (MLAs.)  Notably, after the poaching row, the TRS leader Mr. Pilot Rohit Reddy filed a first information report (FIR) against the BJP and the aforementioned people.   As per police sources, the three detained people were allegedly offering money tune to Rs. 100 crores, to 4 TRS MLAs, following which they were arrested.  

The police filed a charge sheet and booked  Mr. Ramachandra Bharati, Mr. Simhayajulu and Mr. Nanda Kumar under under the Indian Penal Code (IPC) sections 120 B (criminal conspiracy), 171-B (bribery) read with 171-E (punishment of bribery), 506 (punishment for criminal intimidation) read with 34 (acts done by several persons in furtherance of common intention) and section 8 of Prevention of Corruption Act.

The police also sought judicial custody and filed a plea in a city court (the Anti Corruption Bureau,) which got rejected.   The ACB Court judge dismissed the plea citing a lack of evidence.  The court also made it clear that this can’t be treated as a case of corruption and ordered release, after questioning the accused by serving notices under section 41 of the Criminal Procedure Code.

Meanwhile, the City Police is still investigating the matter.
