On the 18th of August, the Supreme Court (SC) uplifted the old rule of the National Defence Academy allowing women to sit for the NDA (National Defence Academy) admission exam.

On Wednesday, the 18th of August, the Top Court slammed the Government of India for their mindset and said, “You (the Government) better change.” The bench led by Justice S.K. Kaul and Justice Hrishikesh Roy said, “This is a mindset problem. You (the government) better change it… don’t force us to pass orders.” The Apex Court further said, “This policy decision is based on gender discrimination. We direct the respondents to take a constructive view of the matter in view of the judgement of this court.”

The judgement of the SC came recently, after a petition was filed demanding inclusion of women for the NDA security exam. The petitioner, Kush Kalra, argued the same and filed a public interest litigation (PIL) petition, demanding entry for women in the NDA.

Upon hearing the petition, the Top Court gave the verdict and criticised the Indian Army for not doing something about it. The SC bench comprising of the SC justices S.K. Paul and Hrishikesh Roy, said, “The endeavour is to persuade the Army to do things itself… We would prefer if the Army did something itself, rather than us passing orders.” The division bench also expressed displeasure over women being denied equal opportunities in the Indian Armed Forces.

The Court claimed the recruitment policy in the NDA, which does not allow women for the NDA is discriminatory and restricts women to serve the Indian Army. The policy is also a violation of the Indian Constitution of India, which dimishes any discrimination between men and women.

However, the Government of India denied the allegations of discrimination and said that there were a wide number of ways in which women could apply to serve India.

Additional Solicitor General Aishwarya Bhati, representing the Government of India said, , “… There is a different kind of training” and claimed that “ultimately it (the barring of women) is a matter of national security”.

However, the Court refused to listen to the arguments further and changed the policy, asking for the inclusion of women in the NDA exams.

The first NDA entrance exam after the judgement is scheduled to be held on the 5th of September.
