SC Asks Central Govt To Provide Marriage Like Benefits For Homosexuals

The Supreme Court (SC) asked the Prime Minister Narendra Modi led Central Government to provide marriage like benefits to homosexuals.

Continuing the court proceedings in the same sex marriage Public Interest Litigation (PIL) filed by many people, the Top Court bench led by the Chief Justice of India (CJI) D.Y. Chandrachud said, “Once you recognise there is a right to cohabit, and it may be symptomatic of a sustained relationship, then it is the obligation of the state that all social impact of the cohabitation has a legal recognition. We are not going into marriage at all.”

In addition, the Top Court asked the Bharatiya Janata Party (BJP) led Central Government to provide legal benefits to the homosexuals, which would help them to live in India with a security net, even if the Government does not legalize same sex marriage.  

Justice Narasimha said, “When we say recognition, it may not always be recognition as marriage. Recognition can mean association, which should entitle them to certain benefits. The association of two people need not be equated to marriage.”

The court is hearing a bunch of PILs filed by homosexual couples in India, seeking legal validation for same sex marriage.
