On August 5, 2016, the Delhi High Court asked the Delhi Police to file an action taken report on a criminal complaint about lodging a FIR against AIMIM President Asaduddin Owaisi. The complaint was alleged offenses of sedition and causing enmity between different groups. The Delhi police pleaded for time to register an action taken report. On Tuesday a Delhi court accepted the police’s plea asking for time. Chief Metropolitan Magistrate Munish Markan granted time to Delhi Police and ordered them to file the report on March 5, 2017.

The plea by the police, requesting time from the court was filed by higher officials of Karawal Nagar Police Station in northeast Delhi in October. The reason for the plea is that the sub-inspector who was assigned to the complaint has been transferred. The plea by the police sought some more time for further inquiry in the matter of the FIR to be lodged.

Brijesh Chand Shukla of Swaraj Janata Party had filed this case against All India Majlis-e-Ittehad-ul Muslimeen (AIMIM) leader Asaduddin Owaisi. Brijesh, the complainant, claimed that he was being pressurized to withdraw the case against Mr.Owaisi. The Complainant had told earlier to the court that he submitted proof of the voice recordings of the objectionable statement and required documents too. But the Police filed a statement on March 13, that the recording proofs and other documents have not been submitted and requested time to dig deep into this matter.

The plea sought a direction to the police to lodge a FIR against Owaisi for alleged offenses under sections 124A (sedition) and 153A (promoting enmity between different groups on grounds of religion, race etc) of IPC. The plea also alleged that the act of the Hyderabad MP showed he was “not loyal to India” and was trying to “harm” the country’s reputation. The statements that Owaisi made, Brijesh said, come under the definition of sedition.
